Currently, Serbia has no special law on Free Legal Aid, although Article 67 of the Serbian Constitution (2006) guarantees the right to legal aid and provides that free legal aid will be regulated by a special law. A public consultation on the newest Draft Law on Free Legal Aid was carried out between December 5th and December 31st 2013.  However, although it was planned that the process of adopting the legislation would be completed in 2014 and its application would start in 2015, the adoption of the Draft Law has not yet occurred by July 2015.

PROCEDURE FOR PROVIDING FREE LEGAL AID IN SERBIA BASED ON THE DRAFT LAW ON FREE LEGAL AID

WHO CAN GET ADVICE:

Everyone seeking general information, initial legal advice, legal-administrative advice and help in filling legal administrative forms (so-called: primary FLA) will have right to receive advice for free from the providers registered by Ministry.

WHO CAN GET LEGAL REPRESENTATION AND HOW:

People seeking legal representations, drafting motions, defence, and implementation of mediation procedure (so-called: secondary FLA) should submit a request for FLA to the local Centre for Social Care. After the approval of the conditions regarding the procedure in which FLA is provided and after verification of the conditions on the side of applicant, the Centre will issue the decision that contains a referral for the applicant to the appropriate registered provider.

Beneficaries can only be a natural person who is eligible to be a beneficiary of the right to financial benefits, or a beneficiary of the right to child allowance, as well as this person’s family or household members determined in accordance with the stated regulations.

Free legal aid can be provided to:

  1.  A citizen of the Republic of Serbia;
  2.  Stateless persons who are legally residing in the Republic of Serbia;
  3.  Foreign nationals with permanent residence in the Republic of Serbia;
  4.  Any other person entitled to free legal aid on the basis of law or a binding international agreement in the Republic of Serbia.

In addition to the persons referred to in paragraph 1 of this Article, free legal aid shall also be reimbursed from the budget, in accordance with the provisions of this law, to:

  1. A child without parental care or contentious parental care;
  2. A person in respect to which a measure of involuntary hospitalization in psychiatric institutions is implemented;
  3. A person in respect to which proceedings for the partial or complete deprivation of legal capacity or restoration of legal capacity are conducted;
  4. A person exercising the right to protection from domestic violence;
  5. A person exercising the right to protection from torture or human trafficking;
  6. A person seeking asylum in the Republic of Serbia;
  7. A refugee or internally displaced person;
  8. A person with disabilities who is a beneficiary of accommodation services in the system of social protection;
  9. A child who is a beneficiary of accommodation services in the system of social protection;
  10. Children and youth who have left the service of accommodation until they reach 26 years of age;
  11. Adults and elderly persons who reside in institutions of social care without their consent;
  12. A person exercising the right to be registered in the register of births in accordance with the rules of law governing contentious procedure.

PROVIDERS OF FLA:

Primary legal aid can be provided by lawyers, public notaries, mediators, legal aid services established in the local self-government units, public authority bodies, associations, and law faculties. A person providing primary legal aid must be a graduated lawyer.

Secondary legal aid can be provided by: lawyers,  notaries and mediators, representatives of legal aid services established in the local self-government units providing a service within the scope of their work; representatives of associations in proceedings before state administrative bodies or organizations entrusted with public authority; representatives of associations in a case in which they have an independent right to file a complaint for a violation of the rights and freedoms of other persons, in accordance with the provisions of special laws; and representatives of associations that may have intervener status in the dispute which shall decide upon the rights, freedoms and interests of a member of the association based on the law, in accordance with the provisions of special laws.

The local self-government unit will establish legal aid services and provide primary and secondary legal aid services. They can organize joint legal aid services with other providers.

WHO GUARANTIES THE QUALITY OF WORK:

The Ministry of Justice controls the quality of FLA.

Quality control includes control over the diligent and professional provision of free legal aid. The ministry shall initiate the procedure of quality control based on the identified irregularities in the exercise of supervision over the implementation of the law; a complaint from the beneficiary; or its own initiative, based on review of the providers’ reports, bills for the cost compensation and records of the provided free legal aid.

If, during the quality control, underperformance in terms of the diligent and professional provision of free legal aid related to the rules of the profession is observed, the provider shall be delivered a written warning, along with a request to make a declaration. A copy of the warning shall be sent to initiate the process of determining the liability of the provider, if the provider is:

  • A lawyer or a public notary, the warning shall be submitted to the responsible professional bodies;
  • A free legal aid service established in the local self-government unit, the warning shall be submitted to the municipal or city council.

After sending the warning, the competent bodies shall implement control procedures in accordance with law and deliver the decision to the ministry. If the competent bodies determine that there has been negligent or incompetent provision of free legal aid, the ministry shall issue a decision on removal from the registry. Pending the decision of the competent bodies, the ministry may prohibit the provision of free legal aid by this provider if it is obvious that they acted negligently or unprofessionally. If the negligent or incompetent provision of free legal aid by other providers is determined in the process of quality control, the ministry shall directly deliver the warning to the provider of free legal aid. In the case of non-compliance with the warning, the ministry shall issue a decision on removal from the registry.

Тренутно, Србија нема посебан Закон о бесплатној правној помоћи, иако члан 67 Устава Републике Србије (2006) гарантује право на правну помоћ и предвиђа да ће бесплатна правна помоћ бити уређена посебним законом. Јавна расправа о најновијем Нацрту Закона о бесплатној правној помоћи је одржана у децембру 2013. године. Међутим, иако је било планирано да се током 2014. године оконча процес усвајања закона и његова примена почне 2015. године, до усвајања нацрта до јула 2015. године још увек није дошло.

ПРОЦЕДУРА ЗА ДОБИЈАЊЕ ПРАВНЕ ПОМОЋИ У СРБИЈИ НА ОСНОВУ
НАЦРТА ЗАКОНА О БЕСПЛАТНОЈ ПРАВНОЈ ПОМОЋИ

КО МОЖЕ ДОБИТИ САВЕТ:

Свако ко тражио опште правне информације, почетни правни савет и правни савет, као и састављања исправе (тзв примарна правна помоћ) има право да добије правну помоћ од стране пружалаца правне помоћи који су регистровани код Министарства.

КО МОЖЕ ДА ДОБИЈЕ БЕСПЛАТНО ПРАВНО ЗАСТУПАЊЕ И КАКО?

Лица која траже заступање, састављање поднесака, одбрану и спровођење поступка посредовања (тзв. секундарна правна помоћ) треба да поднесу захтев локалном центру за социјални рад. Након потврђивања испуњења услова у погледу врсте поступка за који се тражи секундарна правна помоћ и услова на страни лица које тражи секундарну правну помоћ, центар за социјални рад ће издати упут ка одговорајућем пружаоцу правне помоћи.

Бесплатну правну помоћ може користити само физичко лице које испуњава услове да буде корисник права на новчану социјалну помоћ у складу са законом којим се уређује социјална заштита, односно корисник права на дечији додатак у складу са законом којим се уређује финансијска подршка породици са децом, као и чланови његове породице односно заједничког домаћинства, чији је круг одређен овим прописима.
Бесплатну правну помоћ може користити, у складу са одредбама овог закона:

  1. држављанин Републике Србије;
  2. лица без држављанства (апатриди) који законито бораве у Републици Србији;
  3. страни држављани са сталним боравком у Републици Србији;
  4. друга лица за која је законом или међународним уговором који обавезује Републику Србију утврђено да имају право на бесплатну правну помоћ.

Осим ових лица, бесплатну правну помоћ може користити на терет буџетских средстава,у складу са одредбама овог закона, и:

  1. дете без родитељског старања или са спорним родитељским старањем;
  2. лице у односу на које се спроводи мера задржавања и смештаја без пристанка у психијатријској установи;
  3. лице према коме се спроводи поступак делимичног или потпуног лишења или враћања пословне способности;
  4. лице које остварује право на правну заштиту од породичног насиља;
  5. лице које остварује право на правну заштиту од тортуре односно трговине људима;
  6. лице које тражи азил у Републици Србији;
  7. избеглица или интерно расељено лице;
  8. особа са инвалидитетом која је корисник услуге смештаја у систему социјалне заштите;
  9. дете заштићено кроз услугу смештаја у систему социјалне заштите;
  10. деца и млади који су напустили услугу смештаја до навршене 26 године живота;
  11. одрасла и стара лица која су без пристанка на смештају у установи социјалне заштите;
  12. лице које остварује право на упис у матичну књигу рођених у складу са правилима закона којим се уређује ванпарнични поступак.

ПРУЖАОЦИ ПРАВНЕ ПОМОЋИ:

Примарну правну помоћ пружају адвокати, јавни бележници, посредници, службе правне помоћи образоване у јединицама локалне самоуправе, и други органи јавне власти, удружења и правни факултети.
Лице које пружа примарну правну помоћ у правном лицу мора бити дипломирани правник.
Секундарну правну помоћ пружају регистровани пружаоци у складу са одредбама закона којима се уређује поступак: адвокати , нотари и медијатори , у оквиру свог рада, представници служби правне помоћи основаних у јединицама локалне самоуправе ; представници удружења у поступку пред државним органима или организацијама којима су поверена јавна овлашћења ; Пжпредставници удружења у случају у коме су независно право да поднесе жалбу због кршења права и слобода других лица , у складу са одредбама посебних закона .

КО ГАРАНТУЈЕ КВАЛИТЕТ УСЛУГЕ:

Министарство правде гарантује квалитет услуге.

Контрола квалитета обухвата контролу над савесношћу и стручношћу пружања бесплатне правне помоћи. Министарство покреће поступак контроле: на основу утврђених неправилности приликом вршења надзора над спровођењем закона, на основу притужбе корисника, по сопственој иницијативи, на основу увида у извештаје пружалаца.

Ако се приликом контроле квалитета уоче недостаци у погледу савесности или стручности у пружању бесплатне правне помоћи везаних за правила професије, пружаоцу се доставља писано упозорење, уз захтев за изјашњење, а копија упозорења се доставља као иницијатива за покретање поступка утврђивања одговорности пружаоца, и то ако је пружалац: адвокат или јавни бележник, упозорење се доставља надлежном професионалном удружењу; служба бесплатне правне помоћи у јединици локалне самоуправе, упозорење се доставља општинском, односно градском већу.

Након упућивања иницијативе, надлежни органи професионалног удружења, односно јединице локалне самоуправе спроводе поступак контроле у складу са законом и достаљају одлуку министарству. Ако надлежни органи утврде несавесно или нестручно пружање бесплатне правне помоћи, министарство доноси решење о брисању из Регистра.

Ако је у поступку контроле квалитета утврђено несавесно или нестручно пружање бесплатне правне помоћи од стране других пружаоца, министарство доставља упозорење пружаоцу бесплатне правне помоћи. У случају непоступања по упозорењу, министарство доноси решење о брисању из Регистра.
